Terms of Use
METHOD OF PAYMENT: All major credit cards are accepted forms of payment. For large orders (over $5000.00 USD), wire transfer or ACH may be used. Gorilla Spares must be contacted via phone (239-888-0476) or email (sales@gorillspares.com) prior to wire transfers and ACH payment. When using a credit card, the card must be in the name of the person and/or company placing the order. For your protection, Gorilla Spares does not accept credit card info via e-mail. All transactions are in United States Dollars. Credit cards are preauthorized for funds at the time of order with estimated freight; the credit/debit cards are charged the day the order is shipped. International customers can check with their bank or credit card company for conversion rates. Gorilla Spares does not accept company checks or COD as forms of payment.
SHIPPING OPTIONS: All orders are shipped Fed-Ex. Heavy items (over 85 lbs) are shipped via FedEx Freight or best freight option. Gorilla Spares does not offer shipping via USPS or UPS. Pickup fees may apply to DHL. Same day shipping is available for most orders placed before 2:00 P.M. Eastern Standard time, Monday thru Friday. If same day shipping is required, it is the responsibility of the buyer to notify Gorilla Spares at the time of order placement via the order notes or via phone. Custom manufactured items may take longer to process, but normally can be shipped within two (2) days. Estimates or Quotes can be provided upon request. Exact or discounted shipping and insurance charges apply. A handling charge of $3.75 is added to all domestic orders. A handling charge of $10.00 is added to all international orders. Certain products have restrictions due to size or shipping air. Additional crating charges may apply for certain products. Shipping terms are F.O.B. per the specific distributor or manufacturer’s stocking warehouse. All shipments are insured unless otherwise instructed. Product damage or loss incurred in transit is the responsibility of the carrier. Gorilla Spares will provide customers with assistance in tracking packages and filing claims. If a package is lost and the customer cannot wait for the carrier to determine whether a claim will be filed, the customer may have the order duplicated at their expense.
RETURNS: Please call or e-mail our sales department for a return materials authorization (RMA) number and assistance. Custom and special-order items are non-returnable and non-refundable. Returned merchandise and packaging must be in a sellable condition. Any product returned may be subject to a re-stock fee to be determined by the quality control manager of the original manufacturer or distributor. Gorilla Spares LLC, will make a good faith effort for prompt correction or other adjustment with respect to any product which proves to be defective within the warranty period. Shipping cost for returned or exchanged products are the responsibility of the customer. Shipping cost for warranty items are determined by each vendor and their individual policies. If Customer assumes risk of loss while in transit; it is highly recommended the returns be insured. If parts are damaged, inspect the box and notify sales immediately for instructions of saving the box, replacement and carrier claims.
CHANGES OR CANCELLATIONS: Please contact Gorilla Spares for changes or cancellations. We will make every attempt to change or cancel an order. However, because we usually provide same day shipping we cannot guarantee your request will be possible. Shipping charges, refusal fees, and special handling charges will be the responsibility of the purchaser if applicable. Custom jobs will be charged to the degree of progress.
PARTS INTERCHANGABILITY: Interchange, crossover and application data is for Reference Purpose Only. No other conditions are expressed or implied by Gorilla Spares LLC. It is the responsibility of the User and replacement part Manufacturer to verify if the replacement part is interchangeable with the original equipment manufacturer (OEM) part. Please note that in some applications, modifications may be required for proper installation.
USE OF PRODUCTS: Due to the possibility of error in application data or misprints published by Gorilla Spares LLC, and the possibility of non-standard product configurations, Gorilla Spares LLC, cannot be responsible for application of products it sells or represents. In addition, Gorilla Spares LLC, does not exercise control over the installation or use of products we sell or represent, and therefore cannot be responsible for misuse or improper installation. The user of Gorilla Spares LLC, or any Gorilla Spares LLC represented product must verify installation, eligibility, and proper installation and function. Gorilla Spares LLC, disclaims any liability for product defect claims that are due to product misuse, improper product selection or misapplication, and any descriptions that does not express or imply a warranty that the products are merchantable or fit for a particular purpose. If you resell Gorilla Spares LLC, products or products represented by Gorilla Spares LLC, you must exercise due diligence to conform to policies and regulations of U.S. Export requirements and restrictions.
WARRANTY: All products sold by or represented by Gorilla Spares LLC are warranted against defects in workmanship and materials by their original manufacturer for a minimum of one year from the date of sale to the original consumer. Full warranty details are available from specific product manufacturer and should be directly contacted for full details of their respected warranty terms and conditions. Gorilla Spares LLC’s only obligation shall be to repair OR replace at the manufacturers option provided the product it is returned transportation prepaid to the original manufacturer’s factory within one year from the date of sale to the original consumer. Defects or failures due to incorrect installation, failure to start up using OEM guidelines and installation procedures, improper usage or handling, or by any other condition beyond our control, as to any and all of which Gorilla Spares LLC or it’s represented manufacturers will be sole judge, are specifically excluded from this warranty. This warranty gives you specific legal rights. Warranty for product not manufactured by Gorilla Spares is determined by the manufacturer. Contact a Gorilla Spares representative before returning product for information and instructions. Not all products need to be returned. Shipping may be refunded after evaluation but customer assumes risk of loss while in transit. EXCEPT AS PROVIDED IN THIS AGREEMENT, THERE ARE NO EXPRESS WARRANTIES COVERING THE PRODUCTS, AND GORILLA SPARES LLC, SHALL NOT BE RESPONSIBLE FOR ANY INCIDENTAL OR CONSEQUENTIAL DAMAGES RELATING TO, OR RESULTING FROM ANY DAMAGE TO, OR DEFECT IN, SAID PRODUCTS. TO THE EXTENT ALLOWED BY LAW, EXCEPT FOR THE WARRANTY EXPRESSLY PROVIDED IN THIS AGREEMENT, GORILLA SPARES LLC, HEREBY DISCLAIMS ANY IMPLIED WARRANTIES, INCLUDING, WITHOUT LIMITATION, THE IMPLIED WARRANTIES OF MERCHANTIABILITY OR FITNESS FOR A PARTICULAR PURPOSE.
JURISDICTION AND VENUE: The sales agreement was formed in the state of Florida and shall be governed by the laws of the state of Florida. By purchasing a product(s) from Gorilla Spares LLC, Customer hereby submits itself to the jurisdiction of the State of Florida for all disputes arising from or relating to this Agreement or either parties’ performance (or lack thereof) of any obligation under this Agreement. Venue for adjudicating the merits of any claim arising from this agreement shall be solely the Middle District of Florida, Lee County, Florida, and Customer hereby waives any claim of improper venue or that such forum is not convenient; provided, however, that notwithstanding the foregoing, a lawsuit may be filed by a party (the “Plaintiff” against the other party (the “Defendant”) in a court located in the State and County in which the Defendant’s primary place of business is located. Claims made under this agreement shall be made within twelve months of the date of purchase, and the parties to this agreement hereby waive any longer statute of limitations that may be applicable. In the event that legal action be instituted to enforce the terms of this agreement, the prevailing party shall be entitled to reasonable attorney’s fees and costs including costs of collection and reclaiming inventory.
